Thi hành án dân sự tuy là khâu cuối của quá trình tố tụng, là hoạt động cuối cùng trong quá trình thi hành bản án, quyết định có hiệu lực pháp luật của Tòa án theo quy định của luật thi hành án dân sự, song nó là bức tranh rõ nét về chất lượng của quá trình tố tụng. Một bản án, quyết định có hiệu lực pháp luật của Tòa án được tuyên có thi hành được hay không trên thực tế vẫn còn là một chặng đường đầy khó khăn, phức tạp do hệ thống pháp luật về THADS còn chồng chéo, mâu thuẫn giữa luật THADS và các văn bản hướng dẫn, thậm chí mâu thuẫn ngay chính trong nội tại của Luật THADS. Quá trình kiểm sát thi hành án dân sự, phát sinh 01 vụ việc cụ thể như sau:
Ngày 12/3/2013 TAND thị xã Long Khánh, Đồng Nai ban hành quyết định công nhận sự thỏa thuận của đương sự với nội dung: buộc ông Bạch Văn Lữ và bà Lê Thị Đẹp có nghĩa vụ liên đới trả cho bà Nguyễn Thị Đồng số tiền 74.000.000đ. Cùng ngày ông Lữ lập hợp đồng chuyển nhượng quyền sử dụng đất diện tích 1.014,9m2 tại xã Phước Thạnh, huyện Châu Thành do ông đứng tên cho bà Bạch Thị Tây. Ngày 12/4/2013 bà Tây được UBND huyện Châu Thành cấp giấy chứng nhận QSDĐ, ông Lữ sau khi chuyển nhượng không sử dụng số tiền này để thi hành án (trả nợ cho bà Đồng). Ngoài tài sản trên, ông Lữ không có bất cứ tài sản nào để thi hành án.
Ngày 01/10/2017 Chấp hành viên CCTHADS huyện Châu Thành có đơn yêu cầu TAND huyện Châu Thành giải quyết tuyên bố giao dịch vô hiệu theo quy định tại khoản 2 Điều 75 Luật THADS, khoản 1 Điều 24 Nghị định 62/2015/NĐ-CP. Ngày 27/02/2018 TAND huyện Châu Thành ban hành quyết định đình chỉ giải quyết việc dân sự số 15/2018/QĐST-DS với lý do: CCTHADS huyện Châu Thành không thực hiện việc kê biên tài sản đã chuyển nhượng để đương sự thực hiện quyền khởi kiện theo quy định tại khoản 1 Điều 75 Luật THADS mà yêu cầu Tòa án tuyên bố giao dịch vô hiệu theo khoản 2 Điều 75. Trường hợp này, Chấp hành viên chỉ có quyền yêu cầu tuyên bố giao dịch vô hiệu khi đã áp dụng biện pháp ngăn chặn, biện pháp bảo đảm thi hành án, biện pháp cưỡng chế thi hành án nhưng Chấp hành viên chưa kê biên, chưa áp dụng các biện pháp đã nêu ở trên nên Chấp hành viên không có quyền yêu cầu.
Mặc dù vụ việc cụ thể nêu trên được Tổng Cục THADS xác định giao dịch này nhằm trốn tránh nghĩa vụ thi hành án theo quy định tại Điều 24 Nghị định 62/2015/NĐ-CP nhưng đến nay liên ngành vẫn chưa thống nhất quan điểm giải quyết do Tòa án Châu Thành không thụ lý giải quyết vụ việc nêu trên và TAND tỉnh cũng đồng quan điểm không thụ lý.
Bên cạnh đó, nếu Chi cục THADS huyện Châu Thành tiến hành kê biên, định giá bán đấu giá tài sản kê biên và có khách hàng mua trúng giá thì cơ quan THADS cũng không tiến hành giao tài sản được, vì UBND huyện Châu Thành (Cơ quan cấp Giấy chứng nhận QSDĐ) không thể thu hồi giấy chứng nhận QSDĐ cho người trúng giá (Công văn số 51/CNVPDKĐĐ ngày 26/02/2016 của Chi nhánh VP đăng ký đất đai huyện Châu Thành).
